Applicable law and jurisdiction

These legal notices, as well as any contractual relationship arising from the use of the HUBiz platform, are governed by Belgian law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the Commercial Court of Hainaut, Mons division, both for business-to-business (B2B) and business-to-consumer (B2C) relationships.

Legal point of concern:

The Belgian Code of Economic Law (Article VI.83, 23°) presumes unfair, in a contract concluded with a consumer, any clause that obliges them to bring proceedings exclusively in a court other than that of their domicile. A jurisdiction clause invoked against a Belgian consumer or a consumer domiciled in the European Union therefore remains subject to being disregarded by a judge in the event of a B2C dispute, regardless of its wording. The above statement is correct and enforceable for B2B relationships; for B2C relationships, it constitutes an indication of the jurisdiction preferred by Bright Business, without any guarantee of full enforceability against the consumer.
